1. Agreement
These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and RubyX ("RubyX", "we", "us"), governing your access to and use of the RubyX website, dashboard, APIs, software, and related tools (collectively, the "Services"). By creating an account, purchasing a license, or otherwise using the Services you confirm that you have read, understood, and accepted these Terms.
2. Eligibility & Responsible Use
You must be at least 18 years old and legally able to enter into a contract in your jurisdiction to purchase or use the Services. By purchasing a license you represent and agree that:
- You are solely responsible for how you use the Services and for any consequences that result from that use.
- Using third-party software or modifications may breach the terms of service or end-user license agreements of the games and platforms you use them with, and may lead to warnings, restrictions, or bans imposed by those third parties. You accept that risk.
- You will comply with all laws that apply to you and will not use the Services to defraud, harass, or cause material harm to other people.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials, API tokens, license keys, and HWID bindings. You must notify us immediately of any unauthorized access. We may suspend or terminate accounts that show signs of fraud, account sharing, chargeback abuse, or breach of these Terms.
4. Licenses
Subject to payment and continued compliance with these Terms, RubyX grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased product for the duration listed on the order. Licenses are bound to a single hardware identifier (HWID) and may not be resold, redistributed, or reverse engineered except to the extent permitted by mandatory law.
5. Pricing & Payments
Prices are displayed in EUR. Store purchases spend prepaid account credits (1 credit = 1 EUR). Available payment methods are listed in Billing. Review the credit cost and total before confirming an order. Prices may change at any time but already-issued licenses remain valid for their paid term.
6. Acceptable Use
You agree not to:
- Use the Services to harass, defraud, or cause material harm to other players, studios, or platforms.
- Attempt to bypass license checks, rate limits, or HWID enforcement.
- Resell, sublicense, or redistribute the Services outside the official reseller program.
- Upload malicious code, conduct denial-of-service attacks, or probe our infrastructure without written authorization.
Violation may result in immediate termination without refund.
7. Intellectual Property
All software, documentation, branding, and content provided through the Services remain the exclusive property of RubyX or its licensors. No rights are granted to you except those explicitly described in these Terms.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or undetected by any third-party system.
9. Limitation of Liability
To the maximum extent permitted by law, RubyX's aggregate liability arising out of or relating to the Services shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access immediately if you breach these Terms, abuse the platform, or initiate a chargeback without first contacting support. Sections that by their nature should survive termination (including IP, disclaimers, and limitation of liability) will continue to apply.
11. Governing Law
These Terms are governed by the laws of the European Union and, where applicable, the local laws of the country in which RubyX is established, without regard to conflict-of-law principles. Disputes shall be resolved before the competent courts of that jurisdiction, without prejudice to consumer protection rights granted by your country of residence.
12. Changes
We may update these Terms from time to time. Material changes will be announced on the site or by email. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
